Terms and conditions

1. Definitions

“Photographer” refers to Expert Headshots
“Client” refers to the individual or organisation booking the photography service.
“Images” refers to all photographs taken during the session.

2. Booking & Payment

2.1 A booking is confirmed only once the Photographer has received either full payment or a deposit of [amount/percentage], as stated at the time of booking.
2.2 The remaining balance (if any) must be paid on the day of the shoot, in person. Card, Contactless and cash are all accepted
2.3 Prices are quoted in GBP and are inclusive/exclusive of VAT [delete as appropriate].

3. Cancellations, & Rescheduling

3.1 If the Client cancels more than 24 hours before the scheduled session, any deposit paid will be refunded.

3.2 If the client reschedules within 24 hours of the session, the deposit will be transferred to the new session.
3.3 Cancellations within 24 hours of the session will be charged at the full deposit amount.
3.4 The Photographer may reschedule due to illness, emergency, or circumstances beyond their control. In such cases, the Client may choose a new date or receive a full refund.

4. The Photography Session

4.1 The Photographer will make reasonable efforts to produce high-quality professional headshots in line with their portfolio and style.
4.2 The Client is responsible for arriving on time and being prepared (clothing, grooming, etc.).
4.3 Late arrival may reduce shooting time without a reduction in fee.

5. Image Selection & Delivery

5.1 The Client will receive access to a proof gallery or selection process within 2 working days of the session.
5.2 Final edited images will be delivered within 5 working days of selection and full payment.
5.3 Images are delivered digitally via download link. No raw (unedited) files are provided unless agreed in writing.

6. Editing & Retouching

6.1 Basic retouching (e.g. colour correction, minor skin retouching) is included unless stated otherwise.
6.2 Additional or heavy retouching requests may incur an extra fee.
6.3 Editing style is at the Photographer’s discretion and consistent with their portfolio unless agreed in writing with the client.

7. Usage & Copyright

7.1 Copyright of all Images remains with the Photographer under the Copyright, Designs and Patents Act 1988.
7.2 The Client is granted a non-exclusive, perpetual licence to use the Images for personal and professional promotional purposes, including websites, social media, and CVs.
7.3 Images may not be sold, altered with filters, or used for misleading or defamatory purposes without written consent.
7.4 Commercial use beyond self-promotion (e.g. advertising campaigns, resale, third-party use) must be agreed separately in writing.

8. Photographer’s Portfolio & Marketing Use

8.1 The Photographer may use the Images for portfolio, website, social media, and marketing purposes.
8.2 If the Client does not wish for their Images to be used publicly, they must notify the Photographer in writing prior to the session.

9. Liability

9.1 The Photographer will take reasonable care in the performance of the services.
9.2 Liability is limited to the total amount paid by the Client.
9.3 The Photographer is not liable for circumstances beyond their control, including but not limited to equipment failure, venue restrictions, or acts of God.

10. Data Protection

10.1 Personal data is handled in accordance with the UK GDPR and the Data Protection Act 2018.
10.2 Images and client information will not be shared with third parties without consent, except where required by law.

11. Complaints

11.1 Any complaints must be raised in writing within 14 days of image delivery.
11.2 The Photographer will make reasonable efforts to resolve issues but refunds are not provided due to personal taste or style preference.

12. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
